Resumo: This paper aims to presente the provisional execution from the perspective of the creditor in accordance with recent legislative changes, which grafted remarkable degree of satisfaction by authorizing acts of alienation, even when it comes to judgment attacked by appeal without suspensive effect. Consequently, aims also to introduce strict liability of the petitioner in repairing the damage they cause der if the decision is reformed, and reflexes, including third parties, that the decision will lead to reform. At most, we seek to demonstrate, including doctrine and jurisprudence, that the fine article 475-J of the Code Of Civil Procedure does not apply in provisional enforcement and the legal nature of the fine is coercive

Por consequência, almeja, ainda, apresentar a responsabilidade objetiva do exequente em reparar os prejuízos que der causa, caso a decisão exequenda seja reformada, e os reflexos, inclusive perante terceiros, que a reforma da decisão acarretará.
