The present study aims to investigate in the doctrine and national jurisprudence, the origin of the controversy, law emplacements, arguments and the acceptance of the translative effect that may occur in the “Special Appeals”.Currently, the understanding that prevails in Superior Court of Justice is that all matters to be discussed at the “Special Appeals” must be previously questioned, including those of public order, removing the translative effect on this appeal specie.However, there are relatively recent decisions of Superior Court which authorize the recognition of public order issues, although they have not previously been questioned. In doctrine, there are diverse understandings, sometimes defending the possibility of recognition of the matter by Superior Court of Justice, regardless of prior discussion, and sometimes ruling out any possibility, whether by the absence of such law or by express constitutional requirement of prior questioning.The diverse emplacements discussed in the national legal system will guide the present monograph, allowing to evaluate whether even public order issues require previous analysis. These lessons proved to be crucial for a safe approach about the matter
