Resumo: This paper is focused on the analysis of the modern conception of the freedom of choice and pacta sunt servanda and all the legal consequences of the application of these principles. The freedom of choice principle establishes, in general, that individuals may agree with everything that is allowed by the Brazilian Legislation, expressed or implied, and also that the contractual relationship between the parties will have power of law. However, with the modernization of society and the impacts brought by the Brazilian Federal Constitution of 1988 and the Brazilian Civil Code of 2002 this freedom cannot be exercised abusively and arbitrarily in order to put in danger the public interest. Therefore, it is easy to see the relativization of the freedom of choice principle, and consequently of the pacta sunt servanda in this context where other principles, values and the public interest are stronger than the will of the parties.

O princípio da autonomia da vontade, em sua acepção genérica referente à liberdade de contratar, prevê que os particulares podem convencionar sobre tudo aquilo que o ordenamento jurídico, expressa ou implicitamente, não veda e que a relação contratual estabelecida fará lei entre as partes. Contudo, com a modernização da sociedade, os impactos trazidos pela Constituição Federal Brasileira de 1988 e o Código Civil Brasileiro de 2002 esta liberdade não poderá ser exercida de forma abusiva e arbitrária maculando os interesses sociais.
