Resumo: This text aims to study the testament as a contract. This study starts from testament’s dogmatic structure and then investigates the causes that may constitute the invalidity (nullity or annulment) of the testamentary contract based on the general and special rules of the Brazilian Civil Law system and also getting support on the experience from comparative Law. It wil be studied the divergent and convergent points in the systematization of the testamentary invalidities, pointing out the theoretical, practical and jurisprudential problems. Finally, the objective is to analyze the application and effects of the principle of conservation of legal affairs in testamentary matters, with essential guidance on potential legal conditions for the sanation, confirmation, conversion and convalidation of invalidities

Partese de sua estrutura dogmática para, em seguida, investigar as causas que podem configurar a invalidade (nulidade ou anulabilidade) do negócio jurídico testamentário a partir das regras gerais e especiais do sistema de Direito Civil brasileiro, sem prejuízo do apoio e orientação da experiência oriunda do direito comparado. São estudados os pontos divergentes e convergentes na sistematização das invalidades do testamento, apontando-se os problemas teóricos, práticos e jurisprudenciais existentes.
