This paper aims to examine the possibility of assigning the enforceability declaratory judgment, especially from the Civil Procedure Code text reform that change the role of court enforcement orders, brought in his 475-N article, section I. In summary, it analyzed the classification of actions and judicial provisionses, weaving up consideration of the attributes of judicial enforcement orders. In this context, the survey also examined the case and the arguments brought by both sides of the doctrine, both those who are opposed, as those who are in favor of admitting the enforceability of the declaratory judgment. Efforts were also verify that the results of this research will be reflected by the new Civil Procedure Code, as well as examine whether the new Code there will be discussion on the topic in vogue. Finally, the research is finalized outlining the arguments by those who understand the possibility of implementing, in some cases, the declaratory judgment, as well as analyzing the legal consequences of declaratory judgments of reject and illiquid
