Resumo: The undergraduate thesis aims the study of the controversial topic involving the nature of the smuggling crime and the extinction of the punishment due to the payment of the tribute. This importante theme includes and intertwine areas such as tax law, customs duty, and criminal law, that complement each other. The methodology used is the deductive method, combined with the monograph procedure and bibliographic research, through the techniques of Referent, Cathegory, do Concept and bibliographic research2 . Still, as an emphasis, many decisions of the Superior Tribunal de Justiça e do Supremo Tribunal Federal will be analyzed

A relevante temática abarca e interliga temas como o Direito Tributário, Direito Aduaneiro e Penal que, através de um viés multidisciplinar, se complementam. A metodologia utilizada é dedutiva qualitativa, com método de procedimento monográfico e técnica bibliográfica, sendo, para tanto, acionadas as técnicas do Referente, da Categoria, do Conceito e da Pesquisa Bibliográfica .
