Equal pay is the institute that guarantees equal wages to the employees that practice the same tasks, simultaneously, for the same employer, among others requirements and aspects to be studied throughout this dissertation. By respecting the individuality of each employment relationship it’s possible to protect one of the pillars of a just and harmonious society: the principle of equality. As a reflection of the constitutional principle of equality, the pay parity appears as a tool to inhibit prejudice and discrimination at the core of the employment relationship, as it will remain clearly allowed the perception of distinct salary, provided that based on substantial reasons and justifications. A challenge to Law enforcers is not curtailing the employer’s economic development, respecting the governing power, safeguarding, however, the right of workers to a fair and decent wage. At the end of our study, after addressing the aspects involving the legal concept of equal pay, we will have a better comprehension around the constitutional imperative and, therefore, facility to apply it in the daily forensics, as a way to achieve justice
