Resumo: This study aims to analyze the various aspects arising from the use of the coercive penalty provided by the article 461 of the Brazilian Code of Civil Procedure, having in mind that the omission of the legislation in regulating this fine has created numerous gaps that are currently filled by the doctrinaire and court understandings on the matter. Starting with an analysis of the origin of the specific judicial performance, we will discuss its consecration in the Brazilian civil procedural system through the editing of the article 461 of the Code of Civil Procedure, and we will address the broad powers conferred upon the judge to consummate the specific performance, as well as its limitations that stem from the basic principle of due legal process. Entering the central theme of this study, we will address the various issues arising from the application of the coercive fine and that, today, are solved with the extensive body of doctrinal and jurisprudential understandings. Finally, we will briefly discuss some changes proposed by the project of the new Code of Civil Procedure in regards to the fulfillment of specific obligations

Partindo por uma análise da origem da tutela específica, abordaremos a sua consagração no sistema processual civil brasileiro com a edição do art. 461 do Código de Processo Civil, e passaremos a tratar dos amplos poderes de efetivação conferidos ao magistrado, bem como, suas limitações que têm origem no princípio basilar do devido processo legal. Adentrando ao tema central deste estudo, passaremos a tratar dos diversos aspectos decorrentes da aplicação da multa coercitiva e que, hoje, são solucionados diante do extenso acervo de entendimentos doutrinários e jurisprudenciais.
