This monograph's purpose is to assert on the employer's liability in the event of labor misfortune, starting the job with an introduction on the topic, followed by the presentation of theories about the company's liability in case of accident at work. After, discussed the application of subjective and objective employer's responsibilities when the suffering of the accident by the employee, with the presentation of recent changes in labor legislation on the subject, as well as current judged on the subject. Still, the recent changes will be presented in the statement Colendo Superior Labor Court, which determined the existence of temporary stability in the labor misfortune occurring during the term of the contract the employee experience. Finally, it will be a discussion regarding the competence to adjudicate the actions of the employer's liability arising out of the accident, through the enactment of Constitutional Amendment No. 45/2004, as well as Precedent 392 C. TST.
