Serão apresentados os aspectos doutrinários, a legislação vigente e as correntes jurídicas existentes sobre a responsabilidade civil do empregador de modo a identificar e definir os elementos mais importantes dessa relação. As decisões do Tribunal Superior do Trabalho, e seu posicionamento quanto à responsabilidade objetiva, serão observadas com o intuito de demonstrar quão controverso é o tema. O trabalho traz, ainda, uma breve explanação sobre a história e o conceito do acidente de trabalho e das doenças ocupacionais; uma análise das figuras do empregador e do empregado; e, os principais aspectos da segurança e medicina do trabalho, temas esses elencados com fundamento nas Normas Reguladoras da Portaria 3.214/78 do Ministério do Trabalho. O objetivo deste trabalho é tornar claro o entendimento sobre a responsabilidade do empregador no que tange ao acidente de trabalho, posicionando-se a favor da responsabilidade objetiva, por entender que esta é o tipo que mais favorece o empregado.This monograph seeks to analyze the subjective and objective responsibility of the employer when the accident occurred at work, using to this end, the hypothetical-deductive method. Will present the doctrinal issues, existing legislation and the current existing legal liability on the employer to identify and define the most important elements of this relationship. Decisions of the Superior Labor Court, and its position in favor of strict liability, shall be observed in order to demonstrate how the subject is controversial. The work also brings a brief explanation on the history and concept of occupational accidents and occupational diseases, an analysis of figures from the employer and employee, and the main aspects of safety and occupational medicine, these issues listed on the basis Regulatory standards in the Ordinance of the Ministry of Labour 3.214/78.
