The objective of this article is to study the right of proof as opposed to the right of defense required in an advanced production of evidence, as the evidence produced there may be used in any future process, so that the right of defense must be guaranteed, and the party can influence the production of evidences that can be used against it in a future process and even discuss whether or not there is the right to produce that particular evidence. It will also analyze the binding of this evidence in advance, in relation to the parties in the possible main proceedings, taking into account the anticipated production of evidence that does not make a valuable judgment of the evidence across the screen. Therefore, summarized, this article will obtain the right of defense in the advance production of evidence (observance of the principles of the adversary and the broad defense), as well as its possible reflexes and binding on the parties in the possible main proceedings, including in the eventual possibility of new production of evidence in the main proceedings
