This work aims to analyze and clarify obscure issues related to the application of the Novo Código de Processo Civil/2015 in Law 9.099/95. In addition, it Will be demonstrated the position of the Courts and when the Código de Processo Civil should be applied in a subsidiary manner, complementing Law 9.099/95. Several issues still need to be studied and clarified; however, here we highlight some of the points that generated doubts in the legal operators, as well as in the judiciary. In this sense, a study on the sub Law of Special Civil Courts is necessary, as several Special Court magistrates have applied the Código de Processo Civil/2015 in a subsidiary manner, when, obviously, there is no regulation on the sub Law of Special Civil Courts in the Law of Special Civil Courts regulatory law, others do not consider such changes. Therefore, the present work seeks to clarify some of these issues and to understand the positioning of the organs in relation to them
