Resumo: The purpose of this paper is to analyze the applicability of Article 465, Sixth Paragraph of the Civil Procedure Code by our authors and in our case Law. At this step it is necessary to verify the construction of the referred provision so as to guarantee the right of the parties with reasonableness and proportionality in the imposition of the coercive fines and to assure the proper relief. Accordingly, this paper is based on the grounds to impose the fines and their controversies, which prohibit unjust enrichment and the fact that the value and frequency of the coercive penalties not being covered by the “res judicata”.
