Resumo: It aims to present the legislative and jurisprudential historical evolution regarding the restrictions to foreign legal entities and/or national legal entities equated to foreign relative to acquisition of rural properties, especially due to the enforcement of chattel mortgage. Additionally, considering the permission established by Law No. 13,986/2020 to foreigners acquire rural property as real guarantee, this study aims to define the scope of this permission and realize a critical assessment of the legislator's option established in such law
