Resumo: The purpose of this monograph is to systematically analyse the application of the institute for the financing of companies in crisis, especially in attention to the changes that have been made by Law 14.112/2020. In this context, the study begins with the inspection of the basic principles contained in the Federal Constitution of 1988 that govern the bankruptcy legislation, what are, the preservation of the business activity and the social function of the company, and then delves into the Brazilian legislative evolution, with the consecration of judicial recovery as the main means of safeguarding the constitutional precepts of business rehabilitation. Finally, conducting a comparative analysis between foreign law and the most important issues of application in Brazilian law, we are able to cover the maximum number of materials derived from the practical use of this institute, and what would be the main outstanding points of evolution for the due application in Brazil, thus achieving, consequently, a greater number of recoveries of Brazilian companies

Nesse contexto, o estudo inicia com a inspeção dos princípios basilares constantes na Constituição Federal de 1988 que regem a legislação falimentar, quais sejam, a preservação da atividade empresária e a função social da empresa, para após aprofundar na evolução legislativa brasileira, com a consagração da recuperação judicial como o principal meio de salvaguardar os preceitos constitucionais de reabilitação das empresas.
