This study aims to examine the possibility of partial and gradual resolution of merit as an instrument aiming at the timing of the adjudication. Thus, an attempt will be facing issues involving the effectiveness of the process, through the recent reforms of the Code of Civil Procedure, by considering the partial resolution of the merits as an instrument of protection the law already recognized in the course of the dispute quickly and effectively, which breaks down the object of litigation in two parts: an uncontroversial and another controversial. The uncontroversial part of the demand could be resolved with sufficient cognitive load for the formation of res judicata, while the other, still disputed, will be assessed at a later date. Finally, the conclusions will demonstrate the possibility of gradual formation of res judicata in response to the fundamental principles involved in the process, especially with regard to effectiveness, the timing and effective access to justice
