Resumo: The application of the intercurrent prescription on Labor Law is a controversial theme in the doctrine and jurisprudence. Through contextualization, conceptuation and indication of the legal basis, jurisprudence and doctrine knowledge about the present legal institute, this work intends to show its applicability on Labor Law ambit and therefore, examining in which labor process ́ phase the intercurrent prescription occurs, the hypothesis when it can be recognized, in which ways it can be argued, the possibility of its cognizance ex officio and the prescriptional term to be considered
