Resumo: The environment was inserted in the Constitution of 1988 with the status of a fundamental right the whole society and the Government have the duty to protect. The present work aims to study the formula found by the Federal Constitution in order to draw the playing field of federal entities (Federal, State, Federal District and municipalities) to protect the environment without hurting the federal pact. To this end, we discuss first the constitutional treatment given to the environment, secondly the form of government adopted by our country to then outline the responsibilities of counties. On controversial issues the decisions of the courts will be pointed out

O presente trabalho tem a finalidade de estudar a fórmula encontrada pela Constituição Federal para traçar o campo de atuação das entidades federativas (União, Estados, Distrito Federal e Municípios) para a proteção do meio ambiente sem ferir o pacto federativo. Para tanto, abordaremos primeiramente o tratamento constitucional dado ao meio ambiente depois a forma de Estado adotada por nosso país para então delinearmos as competências dos entes federados.
