Teleworking has always been present in labor practice, even before its legal provision with the enactment of L. 13.467/17, as seen in jurisprudence in its time. With the advent of social advances, its practice began to be easier and more embraced. First, we will start the present work with a brief overview of the progress of fundamental workers' rights, to highlight the importance and the growth of the protections given to this under-productive part in labor relations. Notwithstanding the discussion in the present work regarding the relationship between tele-work and the right to disconnect, and the effects of this relationship on the worker's health, it will be demonstrated what kinds of damage can withstand when the right of disconnect is not granted, and its consequential legal consequence. Furthermore, a discussion related about the worker’s physical and psychological health is going to be presented focusing on the necessary repair caused by the violation of the right of no-work, ending the present work with it’s reasons, fundamentals and nature that hover over this repair
