Resumo: The present work critically analyzes the unconstitutionality of the requirement of formal and detailed confession by the Criminal Non-Persecution Agreement, brought by the anti-crime package, Law 13.964/2019. The violated rights and guarantees of the investigated will be presented, as well as the questioning of the constitutionality of the requirement of formal and detailed confession, since it is a new law and infraconstitutional force. The concept, requirements and procedure of the agreement will be presented, as well as a brief comparison with other negotiation modalities in criminal law in order to analyze whether the confession is really necessary, as well as the harmfulness of the investigated, in case he fails to comply with the agreement. Finally, to present the understanding of the higher courts regarding Law 13.964/19, specifically on the non-prosecution agreement and the doctrinal majority understanding

Será apresentado os direitos e garantias violados do investigado, assim como o questionamento da constitucionalidade da exigência da confissão formal e circunstanciada, visto que se trata de uma lei nova e de força infraconstitucional. Serão apresentados o conceito, requisitos e o procedimento do acordo, assim como uma breve comparação com as outras modalidades negociais no direito penal afim de analisar se a confissão é realmente necessária, como também a prejudicialidade do investigado, caso venha descumprir o acordo.
