O papel da Defensoria Pública no acesso à justiça das mulheres em situação de violência doméstica

Resumo: History demonstrates that women have always lived in a situation of inferiority in relation to men. Throughout time, women have been under domestic and family violence. The law 11.340/2006 represented a great innovation in the Brazilian legal system, proposing a broad protection for women in situations of domestic and family violence and also in the search for effectiveness of the constitutional guarantee of equality. Articles 27 and 28 of the referred law, guarantee women to be accompanied by lawyers or public defenders in all procedural, civil and criminal acts. Furthermore, these articles establish that women must have access to services of the Public Defender Office upon specific and humane attendance, whether in police or judicial stages. This work aims to analyze the role of the Public Defender in the access to justice of those women who have been under experiences of domestic and family violence, trying to demonstrate the institution's importance

A Lei 11.340/2006 significou uma grande inovação no ordenamento jurídico brasileiro, propondo uma tutela ampla da mulher em situação de violência doméstica e familiar e na busca da real efetividade à garantia constitucional da igualdade. Os artigos 27 e 28 da citada Lei trazem ainda as garantias de que tais mulheres devem ser acompanhadas, em todos os atos processuais, cíveis e criminais, por advogado ou defensor público e de que todas elas terão acesso aos serviços da Defensoria Pública, em sede policial e judicial, mediante atendimento específico e humanizado.
