The article 285-A was brought to the Civil Process Code by the Law 11.277/2006, enabling the judge, when the disputed matter is exclusively a legal matter and the Lower Court has already rendered a decision dismissing an identical case, discharge the summons and pass a sentence reproducing the tenor of the one previously rendered. The intent of this brief study is to analyze the constitutionality of the afore mentioned article, exploring the pros and cons regarding its applicability, the legal nature of the procedural rules, its legal premises, Court ruling, putting it into practice and applicability extension. It also addresses the new approach on this topic incorporated on the Draft of new Brazilian Civil Procedures Code
