Resumo: The following essay pretends to analyze the rules of distribution of the burden of proof in the brazilian civil procedure and, notably, the possibility of flexibilization depending on the case. It intends to outline the technique of dynamic distribution and to emphasize the important role it takes to comply with the fundamental standards established in the Federal Constitution. The research also highlights the complementary, exceptional and subsidiary character of the dynamic system and the requirements that authorizes and legitimates the redistribution of the burden of proof
