This monograph addresses the theory of dynamic distribution of the burden of proof. Therefore a brief analysis about the legal provisions that deal with the general aspects of the evidence in the Code of Civil Procedure is done. Subsequently, begins the approach of the probationary burden, in particular mentioning the purpose of its use and the general rules applicable to the subject. After it, the existing hypothesis of inversion of the burden of proof are described, and continuing, the positioning concerning the moment for distribution of the burden of proof are mentioned. Finally, the theory of dynamic distribution of the burden of proof and the text of the Project of the New Code of Civil Procedure are analyzed. The conclusion is that the application of the theory of dynamic distribution of the burden of proof is an important instrument for the purpose of enabling the production of evidence by the part that has the best conditions to produce it, especially when it is determined before of the moment of the judgment, in compliance with the constitutional principle of the due process of law
