Resumo: This study aims at analyzing the doctrine of the astreintes as an instrument set forth in the law to give effectiveness to the protection of diffuse and collective rights, comparing it with other mechanisms established in Brazilian law and foreign law, as well as studying their peculiarities. The first chapter presents a study about the collective procedure, the legal interests that it protects and its importance. In the second chapter, we intend to demonstrate the importance and the motivation of the priority of specific performance in the collective procedure, as well as the instruments to achieve such redress. In the third chapter, we present the legal nature and the purpose of contempt of court set forth in the common law, as well as the institute that originated the Brazilian coercive fine (astreinte). In the fourth chapter, we study the particularities of the astreintes specifically as an instrument to give effectiveness to the protection of diffuse and collective rights. Finally, in the fifth and last chapter, we present our conclusions about the present work

O primeiro capítulo apresenta um estudo sobre o processo coletivo, os bens jurídicos por ele tutelados e sua importância. No segundo capítulo, demonstramos a importância e a justificativa da prioridade da reparação in natura no processo coletivo, bem como instrumentos para a consecução da tutela coletiva. No terceiro capítulo, apresentamos a natureza e finalidade do contempt of court previsto no common law, bem como o instituto que originou a multa coercitiva brasileira, qual seja a astreinte. No quarto capítulo, estudamos as particularidades das astreintes especificamente como instrumento de efetivação da tutela dos direitos transindividuais.
