Resumo: The present assignment covers the application of periodic penalty payments to the individual case, since the historical Roman time to the ripeness of current civil procedural law. Furthermore, it manages to demonstrate the inefficiency of jurisdictional custody in the past due to the inexistence of comminatory measures able to enforce the fulfillment of certain obligations and the adjustment in addressing the issue through the years and with the enacting of rules and regulations, both by doctrine and jurisprudence, bringing effectiveness to the fulfillment of the specific performance linked to an obligation to perform or refrain from performing a certain act
