In a context in which new episodes of usurpation of the exercise of the public power due to the relations between public agents and representatives of the private sector are revealed, it is necessary to understand how the legal guardianship can assure a reorganization that can purge or mitigate such harmful relations to society. Therefore, this work analyzes the legal apparatus available to conduct this confrontation. Among the main legal institutes studied, it is worth highlighting the compliance programs as sector responsible for supporting the implementation of corporate governance systems, with internal investigations as one of its main functions. Although it is verified that criminal law alone is insufficient to propose legal measures capable of generating a broad effect on the economy, it is of fundamental importance for individual accountability. Moreover, administrative measures and private investigations can generate reflections that are important to criminal court processing, and therefore deserve to be analyzed from the perspective of the theory of individual liberties
