Resumo: It is analyzed in this study the Article 285-A of the Code of Civil Procedure of 1973, introduced by legislative reform, which allows the trial court order of merit in repetitive claims, without quotation of the defendant. Are dealt with issues concerning to the constitutionality of the provision, the requirements for its implementation, the forms of contesting the decision and response of the defendant, as well as the procedure adopted by the court. The study highlights the intense outcry surrounding the legislative innovation concluding the constitutionality of the standard interpretation when done systematically and with the constitutional principles founded on targeted. Moreover, it is synthetic comparison of the contents of the current Article 285-A with a similar provision contained in the Bill, pending in the Senate, which proposes a new code of civil procedure

São tratados os temas referentes à constitucionalidade da norma, aos requisitos para sua aplicação, às formas de impugnação da decisão e resposta do réu, bem como o procedimento adotado no tribunal.
