Resumo: The aim of this work is to demonstrate some controversial issues related to the penalty provided in art. 475-J of the CPC, brought by the Federal Law N.º 11.232/2005 to perform judicial enforcement of the execution instrument, as its hypothesis of incidence, such the initial term to comply the sentence with the consequent application of the 10% penalty, the doctrinal divergence of the legal nature of the penalty, incidence or not on provisional execution, as well as the constitutional principles and the exclusive of enforcement respected to achieve the objective of the Law, namely the celerity to satisfy the creditor's right through the syncretic process. At the end, will briefly approaches the possible changes that the penalty may suffer with the Draft Law of the new Code of Civil Procedure, Project of Law N.º 8.046/2010
