The possibility of relativizing the res judicata is a current issue that has caused proceduralists and constitutionalists to be divided into two strands: those who argue that it is possible to relativize the res judicata in cases where there is unconstitutionality in its content and there is another part of the doctrine which vehemently dismisses this matter, because they support the constitutional principle of legal certainty. In this way, the legal and doctrinal foundations on the subject will be approached, being mentioned several opposing doctrinators and in favor of the relativization of the res judicata, making a brief explanation about the constitutional principles of legal security and res judicata. At the end, explain the news brought by the Civil Procedure Code of 2015, as well as the current jurisprudence on the subject
