Resumo: The following essay aims to study the institute of the proof, under several nuances. At first, will be studied the development of the concept, its purpose and destination. Then, will be approached the means of proof and its relationship with the Judges powers of investigation. Lastly, will also be studied the concept of the shifting of the burden of proof as a rule to the judgement (or evidentiary phase?) and the reasons why the institute of the “dynamic charge of the proof” has emerged, from its evolution on the Brazilian law to its codification on the Code of Civil Procedure of 2015
