Resumo: | Throughout history, women have been persecuted, tortured, murdered and burned as witches and enslaved, all of which deserve our remembrance. Long before there were feminist movements, they suffered just because they were women and many resisted oppression until the emergence of the first wave of feminists and the enshrinement of the principle of equality in the Universal Declaration of Human Rights in 1948. This principle underwent evolution in various constitutions. , however, from the 1988 Magna Carta, there is a real recognition of material gender equality, bringing fundamental values and significantly influencing the advancement of legal guidelines. In recent years, there has been a significant increase in the inclusion of women in the labor market, however, gender inequalities in the country are still glaring. The Federal Constitution prohibits differential treatment between men and women, as well as other labor standards, with the possibility of activating the judiciary to remedy such inequalities. The woman, previously relegated to the private sphere due to patriarchy, with the advance of time and female struggles, starts to occupy, even if in a small way, spaces that were previously destined only to men. And it is precisely in these conquered spaces that women begin to experience a new violence against them: sexual harassment. This crime is defined by law as the act of constraining someone to obtain sexual advantage or favor, for that, giving priority to a higher hierarchical condition in the exercise of the position. The most victimized women are those who perform the most precarious jobs, with black women often prevailing. It was revealed during the study that most unions do not even have conventions or collective agreements on the subject. There has been a “normization” when it comes to women's achievements and these have been reported through feminist waves; however, effective transformation will only be consolidated with the exclusion of sexual harassment, which is only possible with a cultural change in the entire society |

Muito antes de existirem movimentos feministas, sofreram apenas por serem mulheres e muitas resistiram à opressão até o surgimento da primeira onda feminista e da consagração do princípio da igualdade na Declaração Universal dos Direitos da Pessoa Humana em 1948. Tal princípio passou por evolução nas várias constituições, porém, a partir da Carta Magna de 1988 há um real reconhecimento de igualdade material de gênero, trazendo valores fundamentais e influindo significativamente no avanço das pautas jurídicas. Nos últimos anos, houve aumento significante da inclusão da mulher no mercado de trabalho, contudo anda são gritantes as desigualdades de gênero no país. A Constituição Federal veda o tratamento diferenciado entre homens e mulheres assim como outras normas trabalhistas, havendo a possibilidade do acionamento do poder judiciário para sanar tais desigualdades. A mulher, antes relegada à esfera privada devido ao patriarcado, com o avanço do tempo e das lutas femininas, passa a ocupar, ainda que de forma menor, espaços antes destinados apenas aos homens. E é justamente nesses espaços conquistados é que as mulheres começam a experimentar uma nova violência contra elas: o assédio sexual. Esse crime é definido por lei como o ato de constranger alguém para obter vantagem ou favorecimento sexual, para isso, privilegiando-se de condição superior hierárquica no exercício do cargo. As mulheres mais vitimizadas são as que desempenham os trabalhos mais precarizados, prevalecendo, frequentemente, as negras. Revelou-se durante o estudo que grande parte dos sindicatos sequer possui convenções ou acordos coletivos sobre o tema.
