This essay aims to analyze how the institute of labor accidents should be interpreted considering the new home office rules imposed by Law nº 14.442/2022 and its challenges. Due to the recent popularization of home office work and the recent regulation by Law nº 14.442/2022, which amended the CLT, as well as the COVID-19 pandemic, many employees who used to work entirely in person, migrated to hybrid or definitively tele-in-person regimes, thus, different aspects remained omitted in the aforementioned legislation, causing some confusion about how this new regime would be regulated. In the specific case of labor accidents, the object of analysis in this essay, its regulation in the new labor model remained extremely omitted and nebulous, since the workplace becomes the employee’s residence, even if only partially, therefore, it is difficult to analyze how the employer would adapt and monitor the working environment of its employees, also making it difficult to analyze how far the employer’s responsibilities for accidents occurring to the employee during their workday would extend. Therefore, the present work aims to evaluate the problems and omitted points of the new Law regulating the home-office regime from the perspective of labor accidents
