Resumo: The present study aims to bring to study an ample discussion about the “Fiscal War” resulting from the policy of tax breaks on the Tax on the movement of goods and services - ICMS. This study is made necessary because of the great political and economical dimension of this topic, as well as it relates to the development unity of the country. Still, by means of an ample bibliographic and jurisprudential research, it was sought to analyze the main concepts related this tax, the legal principles involved, in a way it could be analyzed how the policy of fiscal incentives and the breaking of protocols and covenants affects the fiscal balance in the country

O estudo se faz necessário diante da grande dimensão política e econômica do tema, bem como se relaciona com a unidade de desenvolvimento no país.
