Resumo: This monograph has as objective the interdiction institute and the fundamental rights of private sector workers to strike. The main objective of this research is to identify the existence of antagonism between the principles witch compose the basics of the injunction instrument and the principles that leads to the fundamental right of walkout and demonstrate the solutions to solve them. Specific aspects of the right to strike and interdiction were broached such as principles, fundaments and limits for its use. This study encapsulates the interpretation and application of constitutional rules related to the right of work stoppage and the interdiction which is related to the method and principles of constitutional interpretation to solve the principles collision
