This study concerns a new type of vice in Constitutionality Control, that is, the vice of parliamentary procedure, with emphasis on Penal Action 470, which revealed throughout the investigation collusion between parties negotiating political support in exchange for positions and other benefits, a fact proven during the procedural process. Therefore, the votes required by the Federal Constitution of 1988 for the approval of Constitutional Amendment 41/2003 were influenced by the "Mensalão" scheme, violating the provisions of article 55, II and §1 of the Federal Constitution, the Parliamentary Decree that, in general, it would be the ethical behavior before the house that they act, thus, arising the Unconstitutionality by vice of parliamentary decorum
