Resumo: | This work introduce the reality faced for Penal Law in the protection of collective juridical rights at the risk society. In all humanity history always was risks connected with the human companionship in the society or risks due new discoveries to aiming at richness and comfort. This new require that appear in the risk society’s Ulrich Beck, and brought in the Penal Law, with the new technologies used related with global juridical relations using instrumental able of the connected thousands of the people in different parts of the world and in the same time. The globalization of the economy, where the border’s country don’t delimit the extent and potential criminality’s damage, that injure rights and consequently put in risk world-wide financial market and the proper survive all being alive. In this dissertation will be analysed the aspects relationed with the appeared of the second velocity Penal Law and the use of the risk Penal Law in of the a functionality criminal politic and what jurisprudence positioned. |

Em toda a história da humanidade sempre existiu riscos relacionados à própria convivência do ser humano em sociedade, sejam riscos decorrentes das novas descobertas visando à riqueza e conforto. Essa nova demanda que surge dentro de uma noção de sociedade de risco de Ulrich Beck, e trazido para dentro do Direito Penal, com o uso de novas tecnologias relacionadas à globalização das relações jurídicas, com a utilização de instrumentos capazes de conectar milhares de pessoas em diferentes partes do mundo ao mesmo tempo. A globalização da economia, onde as fronteiras de um país não delimitam a amplitude e o potencial de danos da criminalidade, que passa a ofender bens jurídicos e consequentemente coloca em risco o mercado financeiro mundial e a própria sobrevivência dos seres vivos.
