Resumo: Criminal Law is the branch of Law that regulates the punitive power of the State and delimits what are the criminal behaviors, based on a valuation of legal assets. As a result of globalization and technological advancement, the so-called risk society is currently configured, which generally influences life in society. The central objective of this bibliographic and explanatory research is to analyze what are the real functions of Criminal Law in postmodern society, their distortion and disrespect to the basic principles to the detriment of the unbridled expansionism of penal norms. From the entire study, it is possible to conclude that criminal policy is currently being based on social outcry and low-cost political discourse, which seeks immediate solutions, to reduce the feeling of insecurity that plagues all individuals. It can be seen, then, that a change in criminal policy is necessary, so that Criminal Law is able to fulfill its functions and, at the same time, fundamental rights and guarantees are respected.

Em decorrência da globalização e do avanço tecnológico, atualmente, está configurada a chamada sociedade de riscos, que influencia de forma geral na vida em sociedade. O objetivo central dessa pesquisa bibliográfica e explicativa é analisar quais são as reais funções do Direito Penal na sociedade pós-moderna, o desvirtuamento delas e o desrespeito aos princípios basilares em detrimento do desenfreado expansionismo de normas penais. De todo o estudo, é possível concluir que atualmente a política criminal está sendo baseada no clamor social e em discursos políticos de baixo custo, que buscam soluções imediatas, para diminuir a sensação de insegurança que assola todos os indivíduos.
