The purpose of this study is to contextualize the historical environment in which the Condoms and Incorporations Law is introduced in our legal system, its innovations in the protection of the rights of the purchasers, as well as the extraordinary progress which gives it an extrajudicial character, which corroborates for celerity and effectiveness of the process of regularization of the enterprise by the purchasers of units. Its current character unfortunately runs up against some practical issues, but this does not have the power to exclude the relevance of the rights protected and the effectiveness of established institutes. In addition, the importance of resumption of works is emphasized, since it allows a greater security to the acquirer, as well as contributes to the fact that the real estate market and civil construction remains heated, because despite the insolvent or bankruptcy situation of an incorporator, when the group of acquirers deliberates for the resumption of works, opens up opportunities for other developers and builders, keeping the economy warm and more, allowing the incorporation to fulfill its main purpose, its social function that is to deliver the units to the respective buyers. Finally, it portrays, unfortunately, the existence, still of fraudulent incorporation, without registration of incorporation, and the complicating ones, as to the effectiveness of the resumption of works.
