Resumo: This work aims to make a brief analysis of Social Security in Brazil talking about disability benefits and the consequences in employment contracts. Thus, It aims to analyze the situation of employees receiving social security medical discharge or high medical expertise although admittedly disabled, remaining in the so-called “Social Security Limbo” without the means to ensure their own livelihood , which goes against the goals of Social Security. The current law considers it the duty of the employer to pay wages after social security medical discharge, even if deemed unfit by the company’s doctor, which brings new responsibilities to the employer, and transfer him the responsibility for rehabilitation of disabled insured, originally a Social Secutity concern

Tem-se como meta analisar a situação dos empregados que recebem alta médica previdenciária ainda que incapacitados, permanecendo no chamado “limbo previdenciário”, sem meios de garantir o seu sustento, que vai à contramão dos objetivos da Seguridade Social.
