This monograph aims to study the limits of the employer's responsibility in limbo labor pension. The difference between the conclusions of the report of the National Institute of Social Insurance and the doctor work entails the worker situation of difficult solution, since it does not receive welfare benefits, as deemed suitable by the local social security and do not receive salary, since deemed incapable to exercise of their professional activities by the company. In the context, the law has signed understanding in order to assign responsibility to the employer for payment of wages after high social security reforms. From this perspective, it is the study of assumptions, foundations and limits of responsibility. The problem, still attracts the need of perquirir if before the understandings current employee is being adequately protected while holder the right to social security, as well as if there is legal certainty for the employer
