Resumo: The present work aims to study the legal institution called feature means by which the losing party expresses the Judge-state your dissatisfaction with the decision rendered in the case file. The search will bring up the concept, the principles that guided, origin and how doctrine and jurisprudence have the institute. The working face in a kind of special feature, infringing embargoes, for two reasons that the critical part of the doctrine is in its use in the legal environment and compared its repercussions from the event known for its Mensalão and remained in the system

A pesquisa trará o conceito, os princípios que o norteia, origem e como doutrina e jurisprudência vêm o instituto.
