Por um lado, por força do próprio Direito Europeu, e, por outro lado, por força da transposição para o direito nacional e as dificuldades sentidas nessa adaptação legal.De forma a cumprir este propósito irei abordar de uma forma sumária os primórdios do contencioso pré-contratual até, finalmente, como a figura se encontra nos dias de hoje.De início, irei analisar os principais interesses associados ao contencioso pré-contratual bem como a figura legal inicialmente presente no Ordenamento Jurídico Português, fruto das primeira Diretivas Recursos.Num segundo momento, vou aprofundar as alterações ao regime legal por força transposição da Diretiva 2007/66/CE, através do Decreto-Lei n.º 214-G/2015, de 02 de outubro, que instituiu alterações que permanecem até ao dia de hoje.De forma a concluir, vou analisar a fundo as novas alterações ao regime legal, com uma maior atenção ao efeito suspensivo automático na ação de impugnação dos atos de adjudicação.No fim, será possível verificar se estas novas alterações trouxeram uma qualquer vantagem ao regime como este se encontrava assim como indicar algumas novas formas de munir a justiça pré-contratual de melhores meios de resposta aos litígios emergentes no seu seio.The present dissertation aims, in a coherent and structured way, to analyze the regime of pre-contractual litigation as it is currently shaped after the changes promoted by Law N.º 118/2019, of 09.17 and Law N.º 30/2021, of 05.21.As is well known, pre-contractual litigation is, in fact, very volatile and has been subject to several changes over the years.
