Regente da cadeira, Doutor Lúcio Tomé FeteiraThis simple essay has as subject oil arbitration, concretely, the rules applicable to the merits of the dispute. To a better understanding it seems advisable to show, at a glance, the oil industry. These considerations allows the enhancement of the oil arbitration within its international and investment context; the existence of different kinds of arbitrations and the applicable legal frames enshrined in several international and national legal sources. In the aftermath, it seems suitable to tackle some problems and solutions dealt by the arbitrators when it comes to apply the rules to the merits of the dispute. Indeed it is a very difficult and delicate subject. At last, some conclusions will be pointed out. We are perfectly aware that factors related to the nature, difficulty of this issue and due time does not allow us to present an exhaustive treatment of the subject.Este modesto trabalho tem como objeto a arbitragem petrolífera; porém, e tendo em consideração a amplitude do assunto, resolvemos cingi-lo às regras de direito aplicáveis ao mérito da causa. Para sua melhor percetibilidade julgou-se adequado fazer um sumário enquadramento da atividade petrolífera. Este esclarecimento prévio permite destacar a importância da arbitragem petrolífera no contexto da arbitragem internacional e do investimento; respetivas modalidades e instrumentos legais de fonte internacional e nacional que a contemplam. Aqui volvidos consideramos estar em condições para enunciar alguns problemas e soluções com que se depara um árbitro, na delicada e complexa tarefa, aquando da aplicação das regras de direito ao mérito da causa. Por último, seguem-se as principais conclusões a extrair num tema controvertido.
