spelling AS MEDIDAS DE TUTELA E REPOSIÇÃO DA LEGALIDADE URBANÍSTICA A LEGALIZAÇÃO EM CONTEXTO PRÁTICOTHE MEASURES OF PROTECTION OF URBAN LEGALITY LEGALIZATION IN A PRACTICAL CONTEXToperações urbanísticas ilegaislegalizaçãoreposição da legalidaderegulamentos municipaisillegal urban operationslegalizationrestoration of legalitymunicipal regulationsDissertação de Mestrado em Ciências Jurídico-Forenses apresentada à Faculdade de DireitoCom a presente Dissertação propomos fazer uma reflexão sobre a problemática das medidas de tutela e reposição da legalidade urbanística, tendo como “pano de fundo” a figura da legalização em contexto prático.Procede-se a uma análise das alterações introduzidas, nesta matéria, ao RJUE operadas pelo Decreto-Lei nº 136/2014, avaliando a sua suficiência, bem como dos regulamentos municipais, para responder às operações urbanísticas ilegais existentes operando, sempre que for oportuno, uma ligação aos processos que foram objecto de estudo. Por outro lado, pretende-se demonstrar a importância das medidas de controlo prévio e a forma como as mesmas podem contribuir para desincentivar o surgimento de situações que possam configurar uma ilegalidade urbanística.Propomo-nos fazer uma análise crítica aos Regulamentos Municipais de Urbanização e Edificação, (doravante RMUE), dos municípios de Sátão e Penalva do Castelo. Foram analisados alguns processos, que apesar de constituírem uma pequena amostragem eles são, contudo, bem demonstrativos da realidade no que respeita a esta problemática, a sensibilidade e a dificuldade dos responsáveis por estas áreas que diariamente se deparam com esta realidade, pois que cada município apresenta as suas especificidades, um olhar diferenciado perante um caso concreto.Faz-se uma abordagem, talvez um “grito de alerta” para os problemas ambientais os quais vêm há muito tempo suscitando muitas preocupações e que para a sua resolução muito podem, em minha modesta opinião, contribuir os municípios. Por ultimo, uma breve referencia ao modo como os municípios podem contribuir para que as alterações climáticas operadas nas ultimas décadas de forma muito acentuada, possam ser minimizadas. Neste sentido, identificam-se alguns problemas que podem contribuir para o consumo exagerado de água, bem como algumas medidas que podem desincentivar a proliferação de piscinas, o que passaria necessariamente pela obrigação de legalização das existentes.Nesse sentido tentaremos indicar algumas medidas que a nível municipal podem ser tomadas no sentido de minimizar este problema. Conclui-se que, apesar do esforço do legislador no sentido de criar mecanismos que minimizem ou anulem as situações que configurem ilegalidades urbanísticas, bem como o facto de remeter para a Administração municipal a criação de outros mecanismos, todas estas figuras manifestam alguma insuficiência no sentido de dar resposta para grande parte das construções ilegais existentes.With this dissertation we propose to reflect on the problem of measures to protect and restore urban legality, having as a “background” the figure of legalization in a practical context.An analysis is made of the changes introduced, in this matter, to the RJUE operated by Decree-Law No. 136/2014, assessing their sufficiency, as well as municipal regulations, to respond to existing illegal urban planning operations operating, whenever appropriate, a link to the processes that were the object of study.On the other hand, it is intended to demonstrate the importance of prior control measures and the way in which they can contribute to discouraging the emergence of situations that may constitute urban illegality.We propose to make a critical analysis of the Municipal Regulations for Urbanization and Building, (hereinafter RMUE), of the municipalities of Sátão and Penalva do Castelo.Some processes were analyzed, which, despite constituting a small sample, are, however, very demonstrative of the reality with regard to this problem, the sensitivity and difficulty of those responsible for these areas who face this reality daily, since each municipality presents its specificities, a differentiated look at a specific case.An approach, perhaps a “warning cry” is made to the environmental problems which have been raising many concerns for a long time and which, in my humble opinion, the municipalities can contribute to their resolution.Finally, a brief reference to how the municipalities can contribute so that the climate changes operated in the last decades in a very sharp way, can be minimized.
