African health systems’ regulation - the cases of Angola, Cape Verde and Mozambique

Resumo: | The article analyzes experiences of health regulation in African countries, based on the cases of Angola, Cape Verde and Mozambique. After analyzing the goals of health regulation, the authors address the challenges related to the governance of health regulatory systems in most African countries. In the three countries under review, health sector regulation assumes different legal capacities, attributions and scope of intervention of regulatory authorities. Angola and Mozambique, countries in which health regulation is under the responsibility of the Ministry of Health, reveal poorly structured and still largely government-dependent regulatory frameworks. On the contrary, Cape Verde, with several changes to the legal framework of the Regulatory Authorities, presents a more mature regulatory system, currently having a government-independent Health Regulatory Body that congregates the regulation of health care, including medicines. Strengthening the health regulatory framework is critical in African countries as it contributes to ensuring quality and access to health care and thereby contributes to achieving Universal Health Coverage. |

Depois de analisarem os objetivos da regulação da saúde, os autores abordam os desafios relativos à governação dos sistemas regulatórios de saúde na generalidade dos países africanos. Nos três países em análise, a regulação do setor da saúde assume distintas atribuições, capacidades jurídicas e âmbitos de intervenção das entidades reguladores. Angola e Moçambique, países nos quais a regulação da saúde é da responsabilidade do Ministério da Saúde, revelam quadros regulatórios pouco estruturados e ainda muito dependentes do Governo. Pelo contrário, Cabo Verde, com várias alterações ao quadro legal das entidades reguladoras, apresenta um sistema de regulação mais maduro,tendo atualmente uma entidade reguladora da saúde, independente do Governo, que congrega a regulação da prestação de cuidados de saúde, incluindo a área do medicamento.
