Within the first category we will address the complexity of the distinction between package travel and linked travel arrangements, and within the second category we will essentially study how as been affected the right to terminate the travel contract and to recover in full the sums paid in advance when unavoidable and exceptional circumstances occur at the place of destination of the trip,which prevent the realization of the trip in the agreed terms. We will seek here to understand whether the Covid-19 pandemic can be understood as an unavoidable and exceptional circumstance, in what terms art. 25º, n.º 4 of Decreto-Lei n.º 17/2018 should be applied, and how the temporary and exceptional laws that arose in that context resulted in a violation of European law.Taking into account that the European directive provides for a maximum level of harmonization between the legislations of the Member States, the solution to these and other problems is dependent on novelties at a European level, with the exception of what concerns the distribution of the responsibility for the performance of travel services that integrate the contract between organizers and retailers, so the change in our legal system should start here, in order to make the legal frame less penalizing for the latter mentioned. At this point we will analyze the legislative innovation introduced in the Spanish legal system by Ley 4/2022, de 25 de Febrero in order to see if it can inspire the beginning of the end of the inadequate regulation of package travel and linked travel arrangements in Portugal.A presente dissertação tem como objetivo identificar e analisar algumas das principais dificuldades que se colocam nos dias de hoje à regulação das figuras dos contratos de viagem organizada e de serviços de viagem conexos pelo Decreto-Lei n.º 17/2018, de 8 de março, que transpôs para o ordenamento jurídico português a Diretiva (UE) 2015/2302, de 15 de novembro de 2015, com vista a apresentar de forma crítica as soluções que começam a ser debatidas a nível europeu para lhes dar resposta.Essas dificuldades dividem-se em duas categorias: dificuldades congénitas e dificuldades que se revelaram apenas quando o setor do turismo foi fortemente pressionado pelos efeitos da crise pandémica vivida nos últimos anos. Dentro da primeira categoria será abordada a complexidade da distinção entre viagens organizadas e serviços de viagem conexos, e dentro da segunda categoria será essencialmente estudada a forma como foi posto em causa o direito do viajante a rescindir o contrato de viagem e a recuperar a totalidade das quantias entregues de forma antecipada na eventualidade de se verificarem circunstâncias inevitáveis e excecionais no local de destino da viagem, que impeçam a realização da viagem nos termos acordados. Procuraremos aqui entender se a pandemia de Covid-19 pode ser entendida como uma circunstância inevitável e excecional, em que termos deve ser aplicado o n.º 4 do artigo 25º do Decreto-Lei n.º 17/2018, e de que forma os regimes temporários e excecionais que sugiram naquele contexto resultaram numa violação do Direito Europeu.Tendo em conta que a diretiva europeia prevê um nível de harmonização máxima entre as legislações dos Estados-Membros, a solução para estes e outros problemas está dependente de novidades a nível europeu, à exceção daquilo que respeita à distribuição da responsabilidade pela execução dos serviços de viagem que integram o contrato entre agências de viagens e turismo organizadoras e retalhistas, pelo que a mudança no nosso ordenamento jurídico deve começar por aqui, de forma a tornar o regime menos penalizador para estas últimas.
