Moving the relationship between law and literature with deconstruction, proposed by Jacques Derrida: the desire for justice

Resumo: | T The objective of this article is to present the relationship between Law and Literature based on Jacques Derrida's deconstruction, involving the reading of Force of law: the mystical foundation of authority (2018) and This strange institution called literature (2014). In order to do so, at first, we will situate Jacques Derrida's thought regarding deconstruction; then we will present the distinction between law and justice; in a third moment, we will approach Literature as a modern, democratic institution that can say everything. As a result, the research points to the impossibility of separating law and literature, from the point of view of deconstruction, thought of as a desire for justice. The originality of the approach lies in deviating from the canon that addresses the relationship between Law and Literature, presenting such a relationship from the strategy of deconstruction, which signals a theoretical and practical opening to the historical transformations that permanently refound these institutions. |

Para lograrlo, en un primer momento situaremos el pensamiento de Jacques Derrida en cuanto a la desconstrucción; luego presentaremos la distinción entre derecho y justicia; en un tercer momento abordaremos la Literatura como una institución moderna y democrática capaz de expresarlo todo. Como resultado, la investigación señala la imposibilidad de separar el Derecho y la Literatura desde la perspectiva de la desconstrucción, concebida como deseo de justicia. La originalidad de enfoque radica en apartarse del canon que aborda la relación entre Derecho y Literatura, presentando dicha relación desde la estrategia de la desconstrucción, lo que sugiere una apertura teórica y práctica a las transformaciones históricas que refundan continuamente estas instituciones.O objetivo desse artigo consiste em apresentar a relação entre Direito e Literatura a partir da desconstrução de Jacques Derrida, envolvendo a leitura de Força de lei: o fundamento místico da autoridade (2018) e Essa estranha instituição chamada literatura (2014). Para tanto, em um primeiro momento, situaremos o pensamento de Jacques Derrida, quanto à desconstrução; em seguida, apresentaremos a distinção entre direito e justiça; em um terceiro momento, abordaremos a Literatura como uma instituição moderna, democrática, que tudo pode dizer. Como resultado, a pesquisa aponta para a impossibilidade de separação do Direito e da Literatura, do ponto de vista da desconstrução, pensada como desejo de justiça.
