Resumo: This article describes the courts judgments involving the Fies in São Paulo Court of Justice and the Federal Regional Court of the 3rd Region. One of the hypotheses that was expected to be found, since was developed a qualitative and quantitative documental analysis, was the reflection of student indebtedness in the economic life of university students or graduates. However, the great finding of this paper is to show that problems brought to the Judiciary only superficially addresses about issues immediately related to economic life, such as contracts’ interest rate, amortization system or the early maturity of debt. On the other hand, there is a greater problematization of the dealings related to misleading advertising, poor provision of services by higher education institutions and operational failures in the Fies system (SisFies).

Uma das hipóteses que se esperava encontrar, a partir desta análise documental quantitativa e qualitativa, era o reflexo do endividamento estudantil na vida econômica dos universitários ou graduados. Todavia, o grande achado deste trabalho é mostrar que os problemas levados ao Poder Judiciário apenas tangenciam as questões imediatamente relacionadas à vida econômica, como o questionamento de taxa de juros dos contratos, do sistema de amortização ou o vencimento antecipado da dívida.
