An analysis of the applicability of the legal protection of gastronomic heritage for cultural tourism that strengthens identity

Resumo: | The research comes with a contemplative theoretical contribution of the cultural food production of the places, based on a relational approach to these products and the need for their legal protection as a promoter of the preservation of identity cultures, which are an amalgamation between the people and their regions of origin. In this way, the main objective was: to analyze instruments for the protection of terroir food, likely tools to propel tourist destinations. In this pretension, it presents: bibliographical and bibliometric review, being recovered 243 articles in national magazines of the tourism and similar, involving the gastronomy under the bias of the tourist activity. The following search terms were used: “gastronomy”, “gastronomy and cultural identity”, “Geographical Indication”, “Indication of Origin” and “Denomination of Origin”. From the general sample, 38 articles were analyzed, as they dealt with legal instruments that protect gastronomy, such as: the Indicação Geográfica (IG), a Indicação de Procedência (IP) and Denominação de Origem (DO) with the temporality filter “anytime". Being verified that there are many more successes in the application of the instruments in question, than failures. On the other hand, in an attempt to draw attention to the need for changes in its legislation, obstacles were occasionally indicated, which come to hinder this much desired development of locations. |

Deste modo, o objetivo central foi: analisar instrumentos de proteção da comida de terroir, prováveis ferramentas de propulsão de destinos turísticos. Nesta pretensão, apresenta: revisão bibliográfica e bibliométrica, sendo recuperados 243 artigos em revistas nacionais do turismo e afins, envolvendo a gastronomia sob o viés da atividade turística. Foram utilizados os termos de busca: “gastronomia”, “gastronomia e identidade cultural”, “Indicação Geográfica”, “Indicação de Procedência” e “Denominação de Origem”. Da amostragem geral, foram analisados 38 artigos, por abordarem especificamente sobre instrumentos legais protetivos da gastronomia, como o são: a Indicação Geográfica (IG), a Indicação de Procedência (IP) e a Denominação de Origem (DO) com o filtro de temporalidade “qualquer tempo”. Sendo constatado que existem muito mais êxitos na aplicação dos instrumentos em apreço do que falhas.
